Terms of Service

Effective date: 8/25/2026. Please read these Terms of Service ("Terms") carefully. TeenFit by Submerge (the "Service") is operated by TeenFit ("TeenFit", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
Payment processing. Our order process is conducted by Stripe. Stripe handles payment processing, billing, invoicing, applicable taxes, chargebacks, and refund processing for our orders. Customer service inquiries are handled by TeenFit via our Contact page.
1. Eligibility and parental involvement
The Service is intended for individuals aged thirteen (13) years or older. By using the Service you represent and warrant that (a) you are at least 13 years old; (b) if you are under the age of majority in your jurisdiction (18 in most U.S. states), you have obtained parental or guardian permission to use the Service; and (c) you have the legal capacity to enter into these Terms. Parents and guardians who allow a minor to use the Service accept full responsibility for that minor's use.
2. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate information when registering and keep it current. You must notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to other users or to us.
3. Health, fitness, and medical disclaimer
The Service is not a medical device and does not provide medical advice. Content produced by TeenFit by Submerge — including workout plans, calorie estimates, nutrition guidance, and AI coach responses — is provided for general informational, educational, and motivational purposes only. It is not a substitute for the professional advice, diagnosis, or treatment of a qualified physician, licensed dietitian, physical therapist, or certified coach. Never disregard professional medical advice or delay seeking it because of something you read or heard on the Service.
Consult a physician before beginning any exercise or nutrition program, particularly if you have any medical condition (including but not limited to cardiovascular disease, asthma, diabetes, orthopedic injury, disordered eating history, pregnancy, or mental health condition), if you are recovering from injury or surgery, or if you take any prescription medication.
Stop immediately and seek medical attention if you experience chest pain, dizziness, faintness, shortness of breath, abnormal joint pain, or any other symptoms during or after exercise.
4. Assumption of risk and release
Physical activity carries inherent risks including muscle strain, sprains, fractures, cardiac events, and, in rare cases, serious injury or death. By using the Service you knowingly and voluntarily assume all such risks. To the maximum extent permitted by law, you hereby release, waive, and discharge TeenFit by Submerge, its owners, officers, employees, contractors, and affiliates from any and all claims, liabilities, damages, or causes of action arising out of or related to your use of the Service, including injuries sustained while performing recommended activities.
5. Acceptable use
You agree not to (a) use the Service to harass, threaten, defame, or exploit any person, including minors; (b) share content that is illegal, sexually explicit, hateful, or promotes self-harm, disordered eating, or violence; (c) attempt to bypass, disable, or reverse-engineer safety systems in the AI coach; (d) scrape, crawl, or automate access to the Service; (e) upload malicious code; (f) impersonate any person or entity; (g) violate any applicable law or regulation; or (h) use the Service for commercial purposes without our written consent.
6. AI-generated content
The AI coach, workout suggestions, cover images, and voice audio are generated by artificial intelligence. Outputs may be inaccurate, incomplete, or inappropriate for your circumstances. You are solely responsible for evaluating the suitability, safety, and legality of any AI output before relying on it. Do not treat AI output as professional advice.
7. User content
You retain ownership of the content you submit (progress notes, messages, photos, usernames). You grant TeenFit by Submerge a worldwide, royalty-free, non-exclusive license to host, store, reproduce, display, and process that content solely to provide and improve the Service. You represent that you have all rights necessary to grant this license and that your content does not infringe any third-party rights.
8. Intellectual property
The Service, including all software, design, text, graphics, logos, and workout programming, is owned by TeenFit by Submerge or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted to you to use the Service in accordance with these Terms, no rights are granted to you.
9. Payments, subscriptions, and refunds
Certain features are offered on a paid subscription basis (Pro, Elite, Champion). Payments are processed by Stripe, which handles billing, applicable sales tax/VAT, invoicing, and refund processing on our behalf. Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time from the in-app Billing page.
We offer a 30-day money-back guarantee on subscription purchases. Refund requests are handled in accordance with our Refund Policy. We may change pricing on prospective purchases with at least 30 days' notice.
10. Third-party services
The Service integrates with third-party services (e.g., Google Sign-In, Google Calendar, Ko-fi, Stripe, AI model providers). Your use of those services is governed by their own terms and privacy policies. TeenFit by Submerge is not responsible for the availability, accuracy, or content of third-party services.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions the above exclusions apply only to the extent permitted by law.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEENFIT AI AND ITS OWNERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total cumulative liability arising out of or related to these Terms or the Service shall not exceed the greater of (a) one hundred U.S. dollars (US $100) or (b) the amounts you paid us in the twelve (12) months preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless TeenFit by Submerge and its affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) your content.
14. Termination
You may terminate your account at any time from Settings. We may suspend or terminate your access at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Sections that by their nature should survive termination (e.g., disclaimers, liability limits, indemnification, dispute resolution) will survive.
15. Governing law and dispute resolution
These Terms are governed by the laws of the State of Delaware, U.S.A., without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in English, seated in Wilmington, Delaware. You waive any right to a jury trial and to participate in a class action. Notwithstanding the foregoing, either party may bring an individual action in small-claims court, and either party may seek injunctive relief in a court of competent jurisdiction to protect intellectual property rights.
If the arbitration clause above is held unenforceable, the courts located in Wilmington, Delaware shall have exclusive jurisdiction, and each party consents to venue there.
16. Changes to the Service or Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may update these Terms; if we make material changes we will notify you at least 14 days in advance by email or in-app notice. Continued use after the effective date constitutes acceptance.
17. Miscellaneous
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TeenFit by Submerge regarding the Service. If any provision is held invalid, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver. You may not assign or transfer these Terms without our written consent; we may assign them without restriction.
